Delivery, Pickup, and Transfer of Responsibility
We offer multiple methods of product delivery, including carrier shipping, local delivery, and customer pickup.
1. Carrier Shipping (UPS, FedEx, etc.)
All shipments require a signature upon delivery (“Signature Required”).
An order is considered fully completed once the carrier confirms delivery and obtains a signature.
After confirmed delivery, we are not responsible for any loss, theft, damage, or any other circumstances.
2. Failed Delivery and Delivery Attempts
If the customer is not available or unable to sign for the package:
- the carrier may make multiple delivery attempts
- the package may be held at a local facility
- or the shipment may be returned to the sender
If delivery cannot be completed due to customer-related reasons, including but not limited to:
- absence at the delivery address
- refusal to accept the shipment
- incorrect or incomplete address
- failure to provide a required signature
the following conditions apply:
- the customer is fully responsible for all additional costs
- including return shipping and re-delivery fees
- original shipping fees are non-refundable
- we reserve the right to deduct these costs from any refund or require payment before reshipping
Failure to accept delivery or failure to retrieve the shipment does not constitute valid grounds for cancellation or refund.
3. Local Delivery (Direct Delivery by Us)
In certain cases, we may personally deliver and/or assemble the bicycle.
Upon receiving the product, the customer confirms that:
- the product has been received
- the product has been inspected
- the product is in satisfactory condition
From the moment of delivery, all responsibility fully transfers to the customer.
We are not responsible for any damage, loss, misuse, or consequences occurring after delivery.
4. Customer Pickup
If the customer chooses pickup, including fully assembled bicycles, the customer acknowledges that:
- the product has been inspected and accepted in its current condition
- the bicycle is fully functional at the time of transfer
- the product is accepted without claims
All responsibility transfers to the customer immediately upon pickup.
No claims regarding condition, performance, or damage will be accepted after transfer.
5. Fully Assembled Bicycles
If a bicycle is delivered or picked up in fully assembled condition, the customer assumes full responsibility for:
- operation
- safety
- proper use
The customer understands and agrees that improper use may result in injury, property damage, or other consequences.
6. Full Limitation of Liability After Transfer
After delivery, pickup, or any transfer of the product, all responsibility fully transfers to the customer.
Family Store LLC shall not be liable for any consequences arising after transfer of the product, including but not limited to:
- accidents, injuries, bodily harm, or death
- damage to, destruction of, or loss of property
- actions of third parties
- theft, loss, or any form of damage
- misuse, improper operation, or improper storage
- technical issues arising after transfer
- consequences related to charging, connection to electrical systems, power surges, short circuits, or other electrical factors
- fires, overheating, smoke, or any incidents involving the battery or electrical components
The customer assumes full responsibility for the safe use, storage, charging, and operation of the product.
By purchasing the product, the customer agrees that Family Store LLC shall not be liable for any direct or indirect damages, losses, destruction, or consequences of any kind arising from the use of the product.
All risks associated with the product transfer to the customer at the moment of delivery or pickup.
7. Shipping Restrictions
We reserve the right to refuse or cancel any order based on location.
At this time, we do not ship to certain states, including New York.
Any order placed from a restricted location may be canceled at our sole discretion and refunded.
